RESOLUTION N0. 85-14 <br />INTRODUCED BY: Mayor Carmen & Council <br />A RESOLUTION DECLARING T.C. CONSTRUCTION TO BE <br />THE LOWEST AND BEST BIDDER FOR THE PAVEMENT <br />RECONSTRUCTION OF CERTAIN PORTIONS OF THORNAPPLE <br />DRIVE WITHIN MAYFIELD VILLAGE, OHIO, AUTHORIZING <br />THE MAYOR AND DIRECTOR OF FINANCE TO ENTER INTO <br />A CONTRACT WITH T.C. CONSTRUCTION AND DECLARING <br />AN EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. In accordance with bids received pursuant to <br />advertisement as required by law, T.C. Construction is hereby declared <br />to be the lowest and best bidder for the pavement reconstruction of <br />certain portions of Thornapple Drive located within Mayfield Village, <br />Ohio. <br />Section 2. The Mayor and Director of Finance are hereby <br />authorized and directed to enter into a contract with T.C. <br />Construction in an amount not to exceed Thirty Eight Thousand Eight <br />Hundred Twenty Five Dollars and Seventy Five Cents (538,825.75) for <br />the aforementioned project provided that said contract is in <br />conformance with the specifications upon which the bid was received. <br />Section 3. All other bids received are hereby rejected. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compli- <br />ance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />Section 5. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reason that the project authorized herein is necessary to <br />maintain safe travel over the subject roadway. It shall therefore <br />take effect immediately upon passage by the affirmative vote of not <br />less than four (4) members elected to Council and approval by the <br />Mayor or otherwise at the earliest ti allowed b --law <br />/~~ ,-~\ <br />First Reading: 4/15/85 Richard C.
