RESOLUTION N0. 85- 16 <br />INTRODUCED BY: Mayor Carmen & Council <br />A RESOLUTION AUTHORIZING A CONTRACT TO T.C. CONSTRUCTION <br />AS LOWEST AND BEST BIDDER FOR CONCRETE PAV EMENT REMOVAL <br />AND REPLACEMENT ON PORTIONS OF CERTAIN STREETS LOCATED <br />WITHIN THE MUNICIPALITY, TO WIT: OAKTON CIRCLE, TIMBERLINE <br />TRAIL AND WILDWOOD TRAIL, REJECTING ALL OTHER BIDS AND <br />DECLARING AN EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1_. In accordance with bids received pursuant to <br />advertisement as required by law, T.C. Construction is hereby .declared <br />to be the lowest and best bidder for the concrete pavement removal and <br />replacement on portions of certain streets within the municipality, to <br />wit: Oakton Circle, Timberline Trail and Wildwood Trail. <br />Section 2. The Mayor and Director of Finance are hereby <br />authorized and directed to enter into a contract with T.C. <br />Construction in an amount not to exceed One Hundred Four Thousand Four <br />Hundred Eighty Dollars ($104,480.00) for the aforementioned project <br />provided that the contract is based on the specifications upon which <br />the bid was received. <br />Section 3~ All other bids are hereby rejected. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compli- <br />ance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />Section 5. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reason that the contract awarded herein is necessary to main- <br />tain safe highway travel within the municipality. It shall therefore <br />take effect immediately upon passage by the affirmative vote of not <br />less than four (4) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed b a <br />Richard C.
