RESOLUTION N0. 85- l~ INTRODUCED BY: Mayor Carmen & Council A RESOLUTION URGING THE GENERAL ASSEMBLY OF THE STATE OF OHIO TO DEFEAT H.B. 7 WHICH WOULD REQUIRE THE MANDATORY USE OF SEATBELTS IN ALL PASSENGER MOTOR VEHICLES. WHEREAS, the Federal Government has recently indicated that it will negate the requirement of mandatory air bag installation in all passenger motor vehicles if a certain number of states enact mandatory seatbelt legislation; and WHEREAS, H.B. 7 has been introduced into the General Assembly of the State of Ohio mandating the use of seatbelts in all passenger motor vehicles equipped with same; and WHEREAS, it is the opinion of the Mayor and Council of Mayfield Village, Ohio, that H.B. 7 is intended to be used to negate the required installation of air bags; and WHEREAS, the Mayor and Council of Mayfield Village, Ohio, further believe that air bags, and not a mandatory seatbelt law, will provide the greatest safety for ,motorists and help alleviate the growing number of traffic accident fatalities; and WHEREAS, the Mayor and Council further believe that all ,__ state legislators should act to def eat H.B. 7 so as to aid in the implementation of mandatory installation of air bags in all passenger motor vehicles; now, theref ore, BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: Section 1. The Mayor and Council of Mayfield Village, Ohio, hereby urge all members of the General Assembly of the State of Ohio to def eat H.B. 7 for the reasons set forth in the preamble hereto. Section 2,. The Clerk of Council is hereby authorized and directed to forward copies of this Resolution to Governor Richard F. Celeste and to the Cuyahoga County delegation to the General Assembly and in so doing to request from each a written response to this Resolution. Section 3,. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compli- ance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
