RESOLUTION N0. 85-35 (AS AMENDED) <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION GRANTING AN EASEMENT <br />TO THE OHIO BELL TELEPHONE COMPANY <br />FOR THE INSTALLATION, CONSTRUCTION, <br />RECONSTRUCTION, OPERATION, MAINTEN- <br />ANCE, REPAIR AND REMOVAL OF A <br />CONTROLLED ENVIRONMENTAL VAULT AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Ohio Be11 Telephone Company, in an effort to <br />upgrade the communications system in the municipality, has requested <br />the granting of an easement for the installation, construction, <br />reconstruction, operation, maintenance, repair and removal of a <br />controlled environmental vault on property owned by the municipality; <br />and <br />WHEREAS, the Mayor and Council have determined that it is in <br />the best interests of Mayfield Village and its residents to permit <br />this upgrading of the communications system and to grant the requested <br />easement; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL 0~' HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. There is hereby granted to the Ohio Bell <br />Telephone Company, its successors and assigns, a perpetual right-of- <br />way and easement to install, construct, reconstruct, operate, <br />maintain, repair and remove its communications equipment, said ease- <br />ment being more specifically described in Exhibit "A" attached hereto <br />and incorporated herein as if fully rewritten. <br />Section 2. The Mayor and Director of. Finance are hereby <br />authorized and directed to execute an easement, as aforesaid, in a <br />form substantially similar to the one attached hereto, marked Exhibit <br />"A" and incorporated herein as if fully rewritten, provided that the <br />same has been approved by the Director of Law. <br />Section 3~. The easement granted herein to the Ohio Bell <br />Telephone Company is contingent upon compliance by the Ohio Bell <br />Telephone Company with the promissory note payable to Mayfield Village <br />in the amount of Three Thousand Dollars ($3,000.00), a copy of which <br />is attached hereto, marked Exhibit "B" and incorporated herein as if <br />fully rewritten. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compli- <br />ance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />Section 5. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />
