RESOLUTION N0. 85-35 (AS AMENDED) INTRODUCED BY: Mayor Carmen & Council as a Whole A RESOLUTION GRANTING AN EASEMENT TO THE OHIO BELL TELEPHONE COMPANY FOR THE INSTALLATION, CONSTRUCTION, RECONSTRUCTION, OPERATION, MAINTEN- ANCE, REPAIR AND REMOVAL OF A CONTROLLED ENVIRONMENTAL VAULT AND DECLARING AN EMERGENCY. WHEREAS, the Ohio Be11 Telephone Company, in an effort to upgrade the communications system in the municipality, has requested the granting of an easement for the installation, construction, reconstruction, operation, maintenance, repair and removal of a controlled environmental vault on property owned by the municipality; and WHEREAS, the Mayor and Council have determined that it is in the best interests of Mayfield Village and its residents to permit this upgrading of the communications system and to grant the requested easement; now, therefore, BE IT RESOLVED BY THE COUNCIL 0~' HAYFIELD VILLAGE, OHIO, THAT: Section 1. There is hereby granted to the Ohio Bell Telephone Company, its successors and assigns, a perpetual right-of- way and easement to install, construct, reconstruct, operate, maintain, repair and remove its communications equipment, said ease- ment being more specifically described in Exhibit "A" attached hereto and incorporated herein as if fully rewritten. Section 2. The Mayor and Director of. Finance are hereby authorized and directed to execute an easement, as aforesaid, in a form substantially similar to the one attached hereto, marked Exhibit "A" and incorporated herein as if fully rewritten, provided that the same has been approved by the Director of Law. Section 3~. The easement granted herein to the Ohio Bell Telephone Company is contingent upon compliance by the Ohio Bell Telephone Company with the promissory note payable to Mayfield Village in the amount of Three Thousand Dollars ($3,000.00), a copy of which is attached hereto, marked Exhibit "B" and incorporated herein as if fully rewritten. Section 4. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compli- ance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.
