RESOLUTION N0. 85- 40 INTRODUCED BY: Mayor Carmen and Council as Whole ';Y A RESOLUTION AMENDING SECTION 2 OF RESOLUTION N0. 85-4 ESTABLISHING TERMS, CONDITIONS, AND COMPENSATION FOR THE SERVICES OF THE PROSECUTOR, REPEALING ALL RESOLUTIONS INCONSIS- TENT THEREWITH, AND DECLARING AN EMERGENCY. BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: .Section 1. Section 2 of Resolution No. 85-4 is hereby amended to read as follows: (Deleted material appears like ~h~e and new material appears like THIS) Section 2. Effective January 1, 1985, and retro- active thereto, the Prosecutor shall be compensated at the rate of ~'iv~- ~I~~d~ed- ~~gh~y-~~i~ee- I~33~a-rs- $fld- ~i~-i-r~g~- ~`h-r~e2- f;-ent~ ~$a8~,~3~ SIX HUNDRED AND EIGHT DOLLARS AND TWENTY FIVE CENTS (608.25) per month for all services rendered to the municipality in such capacity except as herein otherwise provided. While in attendance at all trials and pretrials in the Lyndhurst Municipal Court on criminal charges brought by Mayfield Village either under its own Codified Ordinances or under the Revised Code of the State of Ohio, and including preliminary hearings in the Lyndhurst Municipal Court on felony charges arising out of Mayfield Village, the Prosecutor shall be compensated at the rate of Fi€ty-Five-Bella~s--F~55:ee~ FIFTY SEVEN DOLLARS ($57.00) per hour, payable upon submission of reasonably detailed billings indicating the name of the case, the date and nature of the proceeding and the time spent. It is understood that such services are rendered by the Prosecutor as an independent contractor and that he is not an employee of the municipality. Section 2. All prior resolutions inconsistent with this resolution in whole or in part are repealed to the extent necessary to avoid conflict with this resolution. Section 3. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements, including the requirements of Section 121.22 of the Ohio Revised Code. Section 4. This Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason that it provides for necessary governmental services.
