RESOLUTION N0. 85- 56 <br />INTRODUCED B Y: Mayor Carmen and Council as Whole <br />r <br />A RESOLUTION AMENDING SECTION 2 OF <br />RESOLUTION N0. 85-4 ESTABLISHING <br />TERMS, CONDITIONS, AND COMPENSATION <br />FOR THE SERVICES OF THE PROSECUTOR, <br />REPEALING ALL RESOLUTIONS INCONSIS- <br />TENT THEREWITH, AND DECLARING AN <br />EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Section 2 of Resolution No. 85-4 is hereby <br />amended to read as follows: (Deleted material appears like <br />~~t9 and new material appears like THIS) <br />Section 2. Effective January 1, 1985, and retro- <br />active thereto, the Prosecutor shall be compensated at the rate <br />of F~~--1~~d-~e~--E-kc~h-t-y'-~~rr-ee--~Do-~~a~s-Tan~d-~hi~ty-~hr~e-E`e-rrts <br />-(~a3 :-3-~~ S IX HUNDRED N INETEEN DOLLARS AND SEV ENTY EIGHT CENTS <br />(619.78) per month for all services rendered to the municipality <br />in such capacity except as herein otherwise provided. While in <br />attendance at all trials and pretrials in the Lyndhurst Municipal <br />Court on criminal charges brought by Mayfield Village either <br />under its own Codified Ordinances or under the Revised Code of <br />the State of Ohio, and including preliminary hearings in the <br />Lyndhurst Municipal Court on felony charges arising out of <br />Mayfield Village, the Prosecutor shall be compensated at the <br />rate of ~i€~~--~~~-Be3:~a~~s--F~55~:-0{~~ FIFTY EIGHT DOLLARS AND FORTY <br />THREE CENTS ($58.43) per hour, payable upon submission of <br />reasonably detailed billings indicating the name of the case, the <br />date and nature of the proceeding and the time spent. It is <br />understood that such services are rendered by the Prosecutor as <br />an independent contractor and that he is not an employee of the <br />municipality. <br />Section 2. All prior resolutions inconsistent with this <br />resolution in whole or in part are repealed to the extent necessary to <br />avoid conflict with this resolution. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 4. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of, the residents of Mayfield Village, Ohio, <br />for the reason that it provides for necessary governmental services. <br />
