RESOLUTION N0. 85- 58 <br />INTRODUCED BY: Mayor Fred N. Carmen <br />A RESOLUTION ACCEPTING FROM S.W. CAPLAN <br />AN EASEMENT FOR THE CONSTRUCTION, <br />MAINTENANCE, OPERATION, INSPECTION, <br />REPAIR, REPLACEMENT AND ALTERATION OF A <br />SANITARY SEWER LINE FOR THE PURPOSE OF <br />SERVING THE HANOV ER WOODS SUBDIV IS ION <br />LOCATED IN MAYF IELD V ILLAG E, OH I0, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, S.W. .Caplan has granted to the municipality an <br />easement for the construction, maintenance, operation, inspection, <br />repair, replacement and alteration of sanitary sewer lines for the <br />purpose of serving the Hanover Woods Subdivision located in Mayfield <br />Village, Ohio; and <br />WHEREAS, the aforesaid easement provides, in part, that S.W. <br />Caplan shall bear the total cost for the installation of the aforesaid <br />sewer line together with all appurtenances thereto; and <br />WHEREAS, the Mayor and Council of the municipality have <br />determined that it is in the best interests of the orderly development <br />of the Village to accept the easement as granted by S.W. Caplan; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Council of Mayfield Village, Ohio does <br />hereby accept the grant of easement from S.W. Caplan for the <br />construction, maintenance, operation, inspection, repair, replacement <br />and alteration of a sanitary sewer line for the purpose of serving the <br />Hanover Woods Subdivision located within the municipality. Said ease- <br />ment shall be in a form approved by the Director of Law and shall be <br />substantially similar to the one attached hereto, marked Exhibit "A" <br />and incorporated herein as if fully rewritten. <br />Section 2. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 3. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reasons set forth in the preamble hereto. It shall therefore take <br />effect immediately upon passage by the affirmative vote of not less <br />
