RESOLUTION N0. 85- 59 <br />INTRODUCED BY; Mayor Fred N. Carmen <br />A RESOLUTION ACCEPTING FROM JEFFERSON <br />PARK PROPERTIES AN EASEMENT FOR THE <br />INSTALLATION AND MAINTENANCE OF A WATER <br />MAIN FOR THE PURPOSE OF SUPPLYING WATER <br />SERVICE TO THE JEFFERSON PARK OFFICE <br />DEVELOPMENT LOCATED IN HAYFIELD VILLAGE, <br />OHIO, AND DECLARING AN EMERGENCY. <br />WHEREAS, Jefferson Park Properties, owner of the Jefferson <br />Park Office Development located within Mayfield Village, Ohio, has <br />granted, to the municipality an easement for the installation and <br />maintenance of a water main for the purpose of supplying water service <br />to Jefferson Park Office Development; and <br />WHEREAS, the aforesaid easement provides, in part, that <br />Jefferson Park Properties shall bear the total cost for the installa- <br />tion of the aforesaid water main and hold the municipality harmless <br />therefrom; and <br />WHEREAS, the Mayor and Council of the municipality have <br />determined that it is in the best interests of the orderly development <br />of the municipality to accept the easement as granted by Jefferson <br />Park Properties; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Council of Mayfield Village, Ohio, does <br />hereby accept the grant of easement from Jefferson Park Properties for <br />the installation and maintenance of a water main for the purpose of <br />supplying water service to Jefferson Park Office Development located <br />within the municipality. Said easement shall be in a form approved by <br />the Director of Law and shall be substantially similar to the one <br />attached hereto, marked Exhibit "A" and incorporated herein as if <br />fully rewritten. <br />Section 2. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 3. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reasons set forth in the preamble hereto. It shall theref ore take <br />effect immediately upon passage by the affirmative vote of not less <br />
