RESOLUTION NOo 84- 30 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION IN OPPOSITION TO H.B. <br />579 PERTAINING TO THE CREATION OF <br />AN OHIO WATER COMMISSION. <br />WHEREAS, H.B. 579 has been introduced into the General <br />Assembly of the State of Ohio; and <br />WHEREAS, H.B. 579 would create an Ohio Water Commission <br />which Commission would adopt and execute a comprehensive plan for the <br />regulation of ground water use throughout the State; and <br />WHEREAS, the Ohio Water Commission, as established under <br />H.B. 579, would restrict the sovereignty of local governments, <br />corporations and individuals which have historically determined usage <br />of ground water on their own premises; and <br />. WHEREAS, the licensing requirements as included in the Ohio <br />Water Commission established under H.B. 579 woula raise the costs for <br />water exploration and development; <br />WHEREAS, the Mayor anci Council of Mayfield Village, Ohio, do <br />support efforts to protect and conserve Ohio's natural water resources <br />but oppose H.B. 579 as being too restrictive and costly in <br />accomplishing said goals; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THATs <br />Section 1 The Mayor and Council of Mayfield Village, <br />Ohio, for themselves and on behalf of all residents of the municipal- <br />ity, urge the Ohio General Assembly to defeat H.B. 579 as currently <br />constituted. <br />Section 2. The Clerk of Council is hereby authorized and <br />directed to certify a copy of this Resolution to Governor Richard F. <br />Celeste, to all members of the Ohio General Assembly from Cuyahoga <br />County, to Vernil'G. Riffep Jr., Speaker of the State House of <br />Representatives, Harry Meshel, President of the Ohio Senate, and in so <br />doing to request each such official to respond in writing to the issue <br />raised herein. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compli- <br />ance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code.
