RESOLUTION N0. 83-17 <br />Page -2- <br />WHEREAS, the Mayor and Council have furthermore been advised <br />that some of those businesses that would conduct retail sales during <br />such a weekend event would contribute six percent (6°s) of their gross <br />sales to the Municipality; and <br />WHEREAS, having carefully considered all of the foregoing, <br />the Mayor and Council have determined that, subject to the guidelines <br />hereinafter set forth, August 26, 27, and 28, 1983 be designated as <br />"Beta Days" in the Mt. Vernon Campus Park; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Council of Mayfield Village do <br />hereby designate August 26, 27, and 28, 1983 as "Beta Days" in the Mt. <br />Vernon Campus Park. <br />Section 2. On the aforesaid dates only, the following <br />terms and conditions shall be applicable to the Mt. Vernon Campus <br />Park: <br />(a) Any of the businesses in the Mt. Vernon Campus Park <br />that voluntarily elect to do so, may provide to the municipality <br />six percent (60) of all gross retail sales conducted on the <br />dates hereinafter set forth; <br />(b) The retail sales shall be conducted on August 26, 1983 <br />from 5:00 P.M. until 9:00 P.M. for Village residents only and on <br />August 27, 1983 and August 28, 1983 from 9:00 A.M. until 5:00 <br />P.M. for the general public; <br />(c) Any expenses incurred for security personnel or police <br />personnel, whether for traffic control or otherwise, shall be <br />borne solely by the participating businesses; <br />Section 3. The Mayor and Council do hereby expressly <br />determine that the "Beta Days°' event ratified herein is being <br />established on the dates indicated as an emergency suspension of the <br />Zoning Code dictates for the sole purpose of providing an opportunity <br />to aid the businesses in the Mt. Vernon Campus Park and such action is <br />not to be construed as establishing the intent of the Mayor and <br />Council to conduct such events in the future or on a continuing basis. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />
