RESOLUTION N0. 83- 23 <br />INTRODUCED BY: Councilman Fred N. Carmen <br />A RESOLUTION AUTHORIZ ING THE <br />PURCHASE OF A LEAF VACUUM ON AN <br />EMERGENCY BASIS AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Council has determined that it is in the best <br />interests of the health, safety and welfare of the residents of <br />Mayfield Village to purchase a leaf vacuum; and <br />WHEREAS, the municipality has been able to obtain a <br />favorable purchase price for such equipment with a delivery date that <br />will permit its use during this Fall season; and <br />WHEREAS, the Council has determined that the purchase of <br />such equipment constitutes a true emergency and, therefore, should be <br />made without the necessity of competitive bidding; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section Zs The Council authorizes the Mayor and Director <br />of Finance to enter into a contract with Gibson-Stewart Co. in an <br />amount not to exceed Six Thousand Three Hundred Dollars (56,300.00) <br />for the purchase of a Giant-Vac leaf vacuum. The Council determines <br />that such purchase constitutes an emergency for the reasons set forth <br />hereinabove. <br />Section 2= That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 3._ This Resolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reasons set forth hereinabove. It shall therefore take effect <br />immediately upon passage by the affirmative vote of not less than five <br />(5) members elected to Council and approval by the Mayor or otherwise <br />
