RESOLUTION N0. 88-9 INTRODUCED BY: Mayor Carmen & Council as a Whole A RESOLUTION AUTHORIZING THE ASSIGNMENT OF THE REFUSE HAULING CONTRACT FROM VILLAGE DISPOSAL, INC. TO ECOLOGY SERVICES, INC. AND DECLARING AN EMERGENCY. WHEREAS, the Council of Mayfield Village, Ohio, adopted Resolution No. 85-47 on July 15, 1985 awarding a contract to Village Disposal, Inc, for rubbish removal in Mayfield Village, Ohio, from August 1, 1985 through July 31, 1988; and WHEREAS, subsequent to the adoption of the aforementioned Resolution and the awarding of the contract authorized therein Village Disposal, Inc. was purchased by Ecology Services, Inc.; and WHEREAS, the Mayor and Council of Mayfield Village, Ohio, are desirous of permitting the assignment of the rubbish removal contract from Village Disposal, Inc, to Ecology Services, Inc, for the balance of the contract term ending July 31, 1988; now, therefore, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: &ection 1. The Mayor and Council of Mayfield Village, Ohio, do hereby authorize and consent to the assignment of the rubbish removal contract from Village Disposal, Inc, to Ecology Services, Inc. for the balance of the contract authorized by Resolution No. 85-47. Section 2. The assignment authorized herein is contingent upon Ecology Services, Inc, performing the said contract in accordance with the same specifications incorporated in the contract with Village Disposal, Inc. Section 3. That the Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. Section 4. This Resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village for the reason that the action taken herein is necessary to maintain an essential governmental service. It shall thetefore take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise
