Carmen <br />? <br />I ? <br />A RESOLUTION AOTHORIZING THE FILING OF AN <br />APPLICATION FOR LAND AND WATER CONSERVATION FUND <br />ACT FINANCIAL ASSISTANCE FOR THE THORNAPPLE DRIVE <br />POND CLEANING AND RECONSTRUCTION AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Federal Land and Water Conservation Fund Act of <br />1965 (Public Law 88-578) provides financial assistance to the State of <br />Ohio for outdoor recreation purposes; and <br />WHEREAS, the Mayor and Council of Mayfield Village are <br />desirous of obtaining financial assistance under the Land and Water <br />Conservation Fund Act program for the Thornapple Drive Pond Cleaning <br />and Reconstruction Project; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Council of Mayfield Village, Ohio, hereby <br />approves the filing of an application for Land and water Conservation <br />Fund Act financial assistance for the Thornapple Drive Pond Cleaning <br />and Reconstruction Project. <br />?i Section 2. The Mayor is hereby authorized and directed to <br />execute and file an application with the State of Ohio Department of <br />• Natural Resources and to provide all information and documentation <br />required in said application for submission to the United States <br />Department of the Interior. <br />Section 3. The Council hereby does further agcee to <br />obligate the funds required to satisfactorily complete the proposed <br />project and thus become eligible for Land and Water Conservation Fund <br />Act financial aid of up to fifty percent (508) of the actual allowable <br />reimbursement cost. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 5. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that time is of the essence in filing the application <br />authorized herein. It shall therefore take effect immediately upon <br />passage by the affirmative vote of not less than five (5) members <br />elected to Council and approval by the Mayor or otherwise at the <br />,
