RESOLUTION N0. 88- 23 <br />INTRODUCED BY: MAYOR CARMEN AND THE ENTIRE COUNCIL <br />AN ffiMERGENCY RFSOLUTION <br />AUTHORIZING TH6 POLICE AND FIRE DSPARTMEN <br />TO RESPOND TO ENISRGENCY CALLS <br />OUTSIDE THS LIliITS OF MAYFffi.D VILI.AGE <br />WFiHRF.AS, Ohio law has authorized municipal carporations to provide police <br />and fire protection services to other municipalities, townships, counties or <br />the State of Ohio without the necessity o£ a contract; and <br />WHER EAS, such police and £ire protection services may be provided only <br />upon the authorization of the legislative body of the municipal corporation. <br />NOW, THEREFORE, BE IT RESOLVED by the Council of Mayfield Village, County <br />of Cuyahoga and State of Ohio, that: <br />SECTION 1: Pursuant to Ohio Revised Code Section 9.60 and 737.041, as <br />amended, this Council hereby authorizes the Chiefs of the Police and Fire <br />Departments, and the Officers on duty in charge of the Police and Fire <br />Departments, to render the services of those departments to other munici- <br />palities, townships, counties or the State in times of emergency, whether or <br />not Mayfield Village has entered into mutual aid contracts for police or fire <br />services with any of those political subdivisions or the State. The determi- <br />nation of "times of emergency" shall be made only by the Chiefs of the Police <br />and Fire Departments, or the Officers on duty in charge of the Police and Fire <br />Departments, upon a call for emergency police or fire protections services by <br />the State or another political subdivision o£ this State. <br />SECTION 2: The personnel of the Police and Fire Departments rendering <br />emergency services to other political subdivisions shall, as provided by State <br />law, be entitled to all of their usual wages and benefits, shall be covered by <br />Workers' Compensation and shall be immune from any liability arising from the <br />reasonable, good-faith rendering of emergency police and fire protection <br />services. <br />SBCTION 3: The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Resolution has been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its Committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all the statutory requirements, including <br />the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4: This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and welfare of
