RESOLUTION N0. 86'=1 <br />Introduced by: Mr. Prager <br />A RESOLUTION.ACCEPTING PLAT AND CONFIRMING PRESCRIPTION <br />OF ECHO DRIVE USED AS A PUSLIC HIGHWAY FOR MORE THAN <br />TWENTY-ONE YEARS <br />WHEREAS, the entire length of Echo Drive has been used as a public highway <br />within the Village of Mayfield, for a period of more than 21 years; and, <br />WHEREAS, it is immediately necessary to install an eight-inch water main, <br />hydrants, and appurtenances thereto in Echo Drive to provide water for adequate fire <br />protection; and, <br />WHEREAS, the Village Engineer has prepared a plat of the entire length of <br />Echo Drive. <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE OF MAYFIELD, COUNTY OF <br />CUYAHOGA, STATE OF OHIO, THAT: <br />Section 1. The plat of the entire length of Echo Drive, prepared by the <br />Village Engineer, be and the same is hereby approved for record purposes only, <br />and the Clerk Treasurer of the Village is hereby authorized and instructed to endorse <br />upon said plat the approval of this council. <br />S.ection 2. Echo Drive has been used as a public street by the public for <br />a period of more than 21 years. <br />Section 3. The Village of Mayfield has also exercised control over such <br />land for more than 21 years. <br />Section 4. Echo Drive has the status of a dedicated highway, although it <br />does not meet the current standards established for public streets in the Village. <br />The passage of this ordinance does not impose the cost of necessary improvements <br />to meet Village standards for public streets upon the Village. <br />Section 5. This Ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, health, safety and <br />welfare of the Village of Mayfield and its inhabitants, in order to provide for <br />the installation of an eight-inch sewer main, and this Ordinance sha11 take effect <br />from and after the date of its passage. <br />Passed this 20th day of Ma}. _ a , 1974. <br />G <br />MAY R- PRESIDENT OF COUNCIL <br />Attest: ? <br />,,(S AL) CLERK-TREASURER <br />?
