RESOLUTION N0, $62 <br />Introduced by: Council as a Whole <br />A RESOLUTION DECLARING THE NECESSITY OF IMPROVING ECHO DRIVE <br />BY THE INSTALLATION OF AN EIGHT-INCH WATER MAIN, HYDRANTS, AND <br />ALL NECESSARY APPURTENANCES THERETO. <br />BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, COUNTY OF <br />CUYAHOGA, STATE OF OHIO, THAT: <br />Section 1. It is hereby determined to be necessary to improve the entire <br />length of Echo Drive by the installation of an eight-inch water main, hydrants, and <br />all necessary appurtenances thereto. <br />Section 2. The plans and specifications for the improvement and the estimate of <br />the cost for the improvement have been prepared by the Village Engineer. The plans, <br />specifications, and estimate of cost for the improvement are placed on file in the <br />office of the Clerk-Treasurer which are hereby approved by this Council. <br />Section 3. It is hereby determined that a petition requesting said improvement <br />has been regularly presented to this Council, and that said petition has been sub- <br />scribed to by the owners of at least 75% of the area to be benefitted from such <br />improvement. Said petition is hereby accepted by this Councile <br />Section 4. The entire cost of said improvement shall be assessed upon the <br />lots and lands which are hereby determined specifically benefitted by said improvements. <br />Said assessments shall be levied by the following, to-wit: <br />In proportion to the benefits which may result from the <br />improvement; and shall be paid when levied, in semi-annual <br />installments at the same rate as is carried by the bonds to <br />be issued in anticipation of the collection thereto, pro- <br />vided, however, that the own.er of any property assessed may, <br />at its option, pay such assessment within 30 days after <br />passage of the ordinance levying such assessments. <br />Section 5. The bonds of the Village of Mayfield shall be issued in antici- <br />pation of the collection of said assessments by installments paid in a period not <br />longer than ten (10) years in an amount equal thereto, and'notes of said Village <br />shall be issued in anticipation of such bonds and of the levying of such assessments. <br />Section 6. The Village Engineer be and he hereby is authorized to prepare an <br />estimated assessment of the cost of said improvement based on the estimate of costs <br />heretofore filed at the office of the Clerk-Treasurer of this Village in accordance <br />with the method of assessment set forth in this Resolution, and showing thereon the <br />amount of the assessment against each lot and parcel of land. Said estimated <br />assessment shall be filed in the office of the Clerk-Treasurer and shall be avail- <br />able for public insp.ection. <br />Section 7. Upon the filing of said estimated assessment as hereinbefore pro- <br />vided, the Clerk-Treasurer is authorized and directed to cause notice of the passage
