<br />BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, CUYAHOGA COUNTY, <br />OHIO, THAT: <br />Section l. This municipality shall join with all other affected municipalities <br />enacting similar legislation in all proper action to determine and enforce its rights <br />and the rights of its residents with regard to the rates charged by the City of <br />Cleveland for water furnished by that City and authorizes the inclusion of this muni- <br />cipality as a party plaintiff in any legal action incidental thereto, including coop- <br />eration and negotiation for the regionalization of the Cleveland Water System. <br />Section 2. This municipality shall join with a11 other affected municipalities <br />enacting similar legislation in sponsoring engineering and technical studies to deter- <br />mine the proper rate structure for the Cleveland Water System in order to gain insur- <br />ance that the problems of the future have been well considered and to provide testimony <br />in any legal action which may be instituted under Section 1 of this Resolution. <br />Section 3.. The Suburban Water Rate Committee of the Cuyahoga County Mayors and <br />City Managers Association is authorized to coordinate s.uch legal action and to employ <br />such professional assistance as it may deem necessary to carry out the intention of <br />Sections 1 and 2 of this Resolution and other incidental, necessary and related work. <br />Section 4. The Clerk is authorized and directed to certify a copy of this <br />legislation to the Executive Secretary of the Cuyahoga County Mayors and City Managers <br />Association. <br />Section 5m The sum of $177.40 is hereby appropriated and shall be paid to the <br />Cuyahoga County Mayors and City Managers Association for the purpose of paying the <br />expenses incidental to the coordination of such activity and employment of professional <br />assistance, which funds shall be held in escrow, disbursed as necessary, and accounted <br />for at reasonable intervals or at any time upon request, with the unused portion of <br />funds to be returned to this municipality at the conclusion of litigation. <br />Section 6. That this resolution.is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof, and provided it receives the affirma- <br />tive voteof two-thirds of all members elected to Council, it shall take effect and be <br />in force immediately upon its adoption and approval by the Mayor. <br />Passed this 16th day of December, 1974. <br />1. ? <br />s <br />- PRESIDENT OF COUNCIL <br />Attest: <br />C ?• ? ?L? <br />AL) CLERK-TREASURER
