Resolution Pdo. 921 <br />Introduced by: Mr. BL1Sa <br />A RESOLUTION AUTHORIZING AND DIRECTING THE LAW <br />DIRECTOR TO PROCEED WITH AN APPEAL IN THE MATTER <br />OF THE CLEVELAND ELECTRIC ILLUMINATING COMPANY <br />VS. VILLAGE OF MAYFIELD, ET AL. <br />WHEREAS, The Cleveland Electric Illuminating Company instituted legal action <br />against the Village of Ma.yfield (Mayfield Village) in the Court of Common Pleas of <br />Cuyahoga County, Ohio, Case #932102; and <br />WHEREAS, the Court entered judgment in favor of the plaintiff on January 16, <br />1976; and <br />WHEREAS, it is deemed to be in the best interest of the residents of this <br />community to appeal the decision of the Court of Common Pleas. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, CUYAHOGA <br />COUNTY, OHIO, THAT: <br />Section l. The Law Director be and he is hereby authorized to (1) request <br />findings of fact and conclusions of law; (2) move the Court to stay execution of <br />the Court's judgment; (3) move the Court to stay any p`roceedings to enforce the judg- <br />ment; (4) prepare a Notice of Appeal and (5) do all things necessary and incident to <br />perfecting an appeal in said proceedings. <br />Section 2. The Law Director is further authorized to immediately order a <br />transcript of the proceedings before the Court of Common Pleas to be filed with the <br />Court of Appeals. <br />Adopted: - February 16, 1976 <br />Attest: <br />CLERK OF COUPdCIL Approved: <br />?- ? <br />1?SA 0
