Resolution No. 922 <br />Introduced by: Mr. Grogan <br />A RESOLLTTION MEMORIALIZING THE ACTION OF THE <br />CI'I'Y OF EAS'IZAKE AND DECLARING AN IIMERCENCY <br />WHEREAS, the voters of the City of Eastlake adopted a Charter requiring <br />stbmission to the electorate of zoning and land use changes; and <br />WfEREAS, the constitutional validity of said Charter provision has been <br />challenged judicially and was sulmitted to the courts for the adjudication of <br />those issues; and <br />!,E]EREA.S, said Charter provision was struck down by the Court, tYius <br />requiring the City of Eastlake to prosecute an appeal to the Supreme Court of <br />the United States; and <br />MERF,AS., the Charter of Mayfield Village grants essentially similar <br />rights to the elec.torate oi this Municipality. <br />NOW, THEREFORE, BE IT RESOLVED BY TBE COUNCIL OF MAYFIE.LD VILIAGE, OHIO, <br />THAT: <br />Section l. The Council of Mayfield Village, Ohio desires to memorialize <br />its concern, interest and support of the City of Eastlake in the prosecution of <br />its appeal before tyhe Supreme Court of the United States. <br />Section 2. The Council also desires to affirmatively express its con- <br />currence with Article III, Section 14 of the Charter of this Municipality which <br />provides the means for the electorate to express itself on proposed zoning and <br />land use changes m <br />Section 3. This ondinance is deemed to be an emergency measure necessary <br />for the immediate preservation of the public peace, healtha safety and welfare in <br />order to support the Charter of Mayfield Village and shall be in full force and <br />effect from and after its date of passage. <br />Adopted4 Feb. 16, 1976 <br />Attest: <br />CLERK OF COIZICIL <br />APPxove!?o 9//C' <br />;- <br />. <br />?-- <br />YOR ? .-
