VETO OF RESOLUTION N0. 966 <br />Pursuant to the Charter of Mayfield Village, Ohio, ArticTe IV, Sec- <br />tion 6, the Mayor hereby vetoes in its entirety Resalution 966 ("R.966"), <br />adopted August 23, 1977. The Charter enables Ma.yfield Village to function <br />under the Home Rule provisions of the Constitution of the State of Ohio, <br />Article XVIII, Sections 3 and 7. Section 7 provides that "any municipality <br />may frame and adopt or amend a charter for its government and may, subject <br />to the provisions af Section 3 of this Article, exercise thereunder any <br />powers of local self-government". This Coim.cil has disregarded its sworn <br />obligation to uphold the Charter of Mayfield Village, which is the basis of <br />all powers granted to the Council. <br />? <br />The following references are addressed to the failure of Council <br />to enact legislation in canformance with the Charter: l. Cotmcil adopted R. 996 in form contrary to the Charter, <br />Article IV, Section 6, which states in part that "the Mayor may approve <br />or veto the whole or any item of an ordinance or resolution appropriating money; but otherwise; his approval or veto shall be addressed to the entire <br />ordinance or resolution". <br />2. Council adopted R. 996 in form and substance contrary to the <br />provisions of the Charter, Article III, Section 11, which states in.part <br />that "each ordinance or resolution...shall take effect, unless a later time <br />be specified therein, upon its signature by the Mayor approving the same, or <br />the expiration of the time within which it may be vetoed by the Mayor, or <br />upon its passage after it has been vetoed by the Mayor, as the case may be...":.
