1. The Contractor is hereby granted the franchise, license and <br />privilege within the territorial jurisdiction of the Village <br />and shall furnish all personnel, labor, equipment, trucks <br />and all other items necessary, to provide refuse collection, <br />removal and disposal services as specified and to perform all <br />of the work called for and described in the Contract docu- <br />ments. As of the date of this Contract, the Village has <br />taken all appropriate action necessary to lawfully grant <br />such franchise to Contractor. <br />2. The Contract shall be £or a period of three (3) years <br />beginning August 1, 1988, and ending July 31, 1991, for <br />a rate of Six Dollars and Five Cents ($6.05) per home per <br />month, together with a charge of One Hundred Ninety Dollars <br />($190.00) per month for rubbish removal at the Village Hall <br />and Service Building, with a ten percent (107) increase in <br />said prices to take effect per annum on the anniversary date <br />of the Contract. <br />3. The Contract documents shall include the following documents <br />and this Contract does hereby expressly incorporate same <br />herein as £ully as if set forth verbatim in this Contract, a <br />copy of which is attached hereto and made a part hereof as <br />"Exhibit A": <br />Note: Items A-H are in the Rubbish Removal (2nd bid) file folder - Clerk of Council '88 fi1e. k <br />A. The Request for Proposals; <br />B. The Instructions to Proponents; <br />C. The Contractor's Proposal; <br />D. The General Specifications; <br />E. The Resolution of Mayfield Village <br />Council ordering or authorizing the work <br />and services contemplated herein; <br />F. The Performance Bond; <br />G. This Instrument; and <br />H. Any addenda or changes in the foregoing <br />documents agreed to by the parties hereto. <br />4. It is the controlling intention of both the Village and <br />Contractor that the Contractor shall at all times occupy <br />the status of an independent contractor and pot that of <br />any employee, agent or legal representative of the Village. <br />Page 2 of 5
