- RESOLUTION N0. 88- 39 INTRODUCED BY: Mayor Carmen and Council as a Whole A RESOLUTION DECLARIldG A& J CSMEN'P CONTRACTORS TO BE THE LOWBST AND BSST BIDDER FOR THE R&SURFACING OF CERTAIN STREETS WITHIld THE MUNICIPALITY, AUTHORIZING THE MAYOR AND PRBSIDHNT OF COUNCIL TO ffiCECOTS A CONTRACT WITH A& J CEMENT CONTRACTORS IN AN AMOUNT NOT TO EXCESD EIGHTY-NINE THOUSAND FIFTY DOLLARS ($89,050.00), xaJacTINc nia, oTHER sms xECrsvEo AND DHCLARING AN ENffi2GBNCY BB IT RESOLVSD BY THE COUNCIL OF MAYFIffi.D VILLAGB, OHIO, THAT: SECTION 1: In accordance with bids received, pursuant to advertisement as required by law, A& J Cement Contractors is hereby declared to be the lowest and best bidder for the resurfacing of certain streets within the municipality. SECTION 2: The Mayor and President of Council are hereby authorized and directed to execute a contract with A& S Cement Contractors in an amount not to exceed Eighty-Nine Thousand Fifty Dollats ($89,050.00) for the aforesaid project, provided that said contract is in accordance with the specifications upon which the bid was received. SECTION 3: All other bids received are hereby rejected. SECTION 4: The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have Seen taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 5: This Resolution is hereby declared to be an emexgency measure necessary for the immediate preservation of the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason that the contract authorized herein is necessary to maintain an effective street repair program within the municipality to provide for safe vehicular traffic.
