- RESOLUTION N0. 88- 39 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />DECLARIldG A& J CSMEN'P CONTRACTORS TO BE <br />THE LOWBST AND BSST BIDDER FOR THE R&SURFACING OF <br />CERTAIN STREETS WITHIld THE MUNICIPALITY, <br />AUTHORIZING THE MAYOR AND PRBSIDHNT OF COUNCIL TO <br />ffiCECOTS A CONTRACT WITH A& J CEMENT CONTRACTORS <br />IN AN AMOUNT NOT TO EXCESD EIGHTY-NINE THOUSAND FIFTY DOLLARS <br />($89,050.00), xaJacTINc nia, oTHER sms xECrsvEo <br />AND DHCLARING AN ENffi2GBNCY <br />BB IT RESOLVSD BY THE COUNCIL OF MAYFIffi.D VILLAGB, OHIO, THAT: <br />SECTION 1: In accordance with bids received, pursuant to advertisement <br />as required by law, A& J Cement Contractors is hereby declared to be the <br />lowest and best bidder for the resurfacing of certain streets within the <br />municipality. <br />SECTION 2: The Mayor and President of Council are hereby authorized and <br />directed to execute a contract with A& S Cement Contractors in an amount not <br />to exceed Eighty-Nine Thousand Fifty Dollats ($89,050.00) for the aforesaid <br />project, provided that said contract is in accordance with the specifications <br />upon which the bid was received. <br />SECTION 3: All other bids received are hereby rejected. <br />SECTION 4: The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Resolution have Seen taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 5: This Resolution is hereby declared to be an emexgency measure <br />necessary for the immediate preservation of the health, safety and welfare of <br />the residents of Mayfield Village, Ohio, for the reason that the contract <br />authorized herein is necessary to maintain an effective street repair program <br />within the municipality to provide for safe vehicular traffic.
