c •• no action 1988 <br />RESOLUTION N0. 88- 43 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A R&SOLUTION <br />AUTHORIZIIdG THS MAYOR AND DIRECTOR OF FINANCE <br />TO ACCSPT A RIGHT-OF-WAY EASffiMENT FROM <br />PROGRESSNS IldSURANCE COMPANY FOR THS <br />PURPOSE OF CONSTRUCTING AND MAINTAIIdING A <br />TRAFFIC SIGN POLS AND DECLARIIdG AN ffi'!S[ZM CY <br />WHERF.AS, Progressive Insurance Company has offered to grant an easement <br />to Mayfield Village for the purpose of constructing and maintaining a traffic <br />sign pole on its property in order to assure the continued flow o£ traf£ic <br />through the area; and <br />F,HERFAS, the Mayor and Council of the municipality have expressed a <br />desire to accept said easement for the purpose hereinbefore mentioned; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SBCTION 1. The Mayor and Director of Finance are hereby authorized and <br />directed to accept the grant of easement £rom Progressive Insurance Company <br />for the construction and maintenance of a traffic sign pole provided that said <br />easement is approved by the Director of Law and is in substantially the same <br />form as that attached hereto and marked "Exhibit A." <br />SECTION 2. The Council finds and determines that all formal actions o£ <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such £ormal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3: This Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the health, safety and welfare <br />o£ the residents of Mayfield Village for the reason that the grant of easement <br />is necessary in order for the municipality to assure the continued flow of <br />traffic through the Village. It shall, therefore, take effect immediately
