Rf(:II1' GI' WnY r,n::r,ni:NT Exhibit "A" <br />Resolution 88-43 <br />PAOGRESSIVE INSURANCE COMPANY ("GRANTOR"), of Mayfield Village, <br />Cuyahoga County, Ohio a company or9anized and opcratin9 pur- I <br />suant to Ohio law, and the ovner of the real property described <br />hereinhelow, for valuable consideration paid, conveys and grants ? <br />to MAYFIELD VILLAGE, ("Grantee"), a Municipal Corpoiation duly <br />organized nnd existing under the laws of the Stntc of Ohio, lo- <br />cated in Cuyahoga Countyi Ohiog a perpetual easement for the <br />constiuction, maintenance, inspection, opeiation, pcotection,xepair and replacement of a Traffic Sign Pole within the follow- <br />ing described lands, of which Grantor warrants he is the owner in{ <br />Fee Simple: I <br />Parcel No. 831-35-4 <br />Situated in the Village of Mayfield, County of Cuyahoga <br />and State of Ohio and known as 6eing part of Original <br />Mayfield Township Lot No. 16, and bounded and described <br />as follows: <br />Heginning at a point in the centerline of Wilson Mills i <br />Road (80 feet wide), which is distant South 88°40'10" <br />. East along said centerline, 90.76feet from its inter- ? <br />section with the centerline of Alpha Drive (80 feet wide); j <br />Thence Sou[h 1°19'50" west, a distance of 40.00 feet to i <br />a point on thesoutherly line of said wilson Mills Road, <br />and principal place of beginning of the pascel of land <br />herein described; i <br />Thence continuing Sou[h 1°19'50" West, a distance of ' <br />3.00 feet to a point; i <br />Thence South 88°40'10" East, a distance of 3.00 feet to I <br />a point; <br />Thence North 1°19'50" East, a distance of 3.00 feet to <br />a point on the Southerly line of said Wilson Mills Road; <br />Thence Nocth 88°40'30" West, along sdid Southerly line, <br />a distance of 3.00 .feet to the principal place of be- <br />ginning, containing 9 square feet of land, be the same <br />more or less, but subject to all legal highways. <br />together with the right of unimpaired access [o said traffic <br />sign pole and the right of ingress and egress on, over and I <br />thz6ugh the above-described premises for any and all purposes <br />necessary and incident to the exercise by said Grantee of the <br />rights granted hereundex. <br />The said Grantor shall have the right to use and enjoy the above? <br />described land except as the same may be necessary for the pur- <br />pose hexein granted to said Grantee. Grantor agrees not to I <br />build, create or construct any obstructions, engineering works, ? <br />or other structures over said traffic sign pole nor permit the i <br />same to be done by others. If Grantee has-to excavate this I <br />area in order to repair oz replace said tsaffic sign pole, then <br />Grantee agreea to restore the property to substantially its <br />original condition. <br />Grantee further agrees to indemnify and hold harmless the Granto ? <br />from any and all claims arieing from or in any way connected with <br />the construction, maintenance, malfunction, use, or any other ? <br />claim or demand whatever arising from or in any way connected <br />with the use of said traffic sign pole. <br />The terms, conditions and proviaions of this Easement shall ex- <br />tend to and be binding upon the heirs, executors, administrators, <br />personal representatives, auccessora and assi9ns of the parties <br />hereto and may be assigned in whole or in part.
