RESOLUTION No. 597 By Mr. Mason 0 ,A. RESOLUTION OBJECTING TO THE ISSUANCE OI' A D-5 LIQUOR--F~[LMIT TO ANITA' J. NUIBE. AT _ 849' ~SOM CENTER ROAD, .MAYFIELD_ VILLAGE, ,CUY,AHOG,A, COUNTY, OHIO.. WHEREAS, the Clerk of the Village of rlayfield has received a Notice dated December 27, 1963, from the Director of the Department of Liquor Control of the State of Ohio of the filing .of an Application on December_17, 1963, by Anita J. Nuibe for a D-5 Liquor Permit for use at 849-SOH Center Road, Village of Mayfield, Cuyahoga County, Ohio; and _ WHEREAS, this Council is not satisfied as to the reputability of the said Applicant, as it has no lcnowledge whatsoever concerning her, and she does not reside or do business at 849 SOM Center Road, nor has she any interest in the premises by way of a sale or lease, nor has she any agreement with the owner to operate under a D-5 permit; and WHEREAS, this Council finds that said premises are not suitable for the operation of such a permit, because they are only 325 feet from a Church and Sunday School and only 687 feet from a Public School, because numerous school children must pass daily on the sidewalk in front of said premises, because of lack of proper f acilities for such a business at said address, because the only building on said premises is a gasoline filling station in no way suitable for operation under a D-5 permit, because behind the gasoline station is a large yard containing used auto parts and scrap, and because in no respect are said premises adequate for a D-5 operation. NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD CUYAHOGA COUNTY OHIO , . THAT s _ _ - - . - - - Sec. 1. Council of the Village of Mayfield, Ohio, hereby objects to the issuance of a D-5 Liquor Permit to Anita J.~Niiibe at 849 SOM Center Road, Village of Mayf field, Ohio, both on the basis of the reputability of the Applicant and the suitability of the location described in the Notice received from the Department of Liquor Control. Sec. 2. The Clerk is hereby directed to send to the Director of the Department of Liquor Control two certif led copies of this Resolution, together with a written..statement, to be signed by the Mayor, of Council*s reasons for objecting to the issuance of said permit, a copy of which statement has been filed with this Council and is hereby approved.
