' RESOLUTION No. 619 <br />By NIr. Mason <br />P.ESOI,UTION APPROVING THE PRE".LII~3INA_ttY P7~.A.N <br />OF PROIOSED AINTRBE PARK SUBDIVISION <br />T~t'FIEREAS, the Preliminary Plan of the proposed Aintree Park Subdivision <br />for approximately 101 sublots, as prepared by Frank Ir. woodruff and Associates, <br />Civil Engineers and Surveyors, under date of October, 1964, has been approved <br />by the Village Engineer and the Village Planning & Zoning Commission; and <br />~~THERI';.AS, Sublots Nos. 11 to 15 both inclusive on the East side of <br />,Aintree Park Drive proposed do not conf orm strictly with the requirements <br />of the ordinances of the Village of I~Iayfield of 20,000 square feet for each <br />lot, Sublot No. 11 being 18,400 square feet in area, and Sublots Nos. 12, 13,14 <br />and 15 being 19,000 square feet in area each, the reason for the variance being <br />the widening of SOM Center Road; and <br />~rTHEI2EAS, Sublots Nos. 55 to 60, both inclusive,,are each 19,000 square <br />feet in area and Sublots Nos. 61 and 62 are 19,100 square feet in area each, <br />because of the fact that the provisions of Ordinance No. 159, the Zoning <br />Ordinance of the Village of S~iayfield, as amended, pertaining to apartments, <br />require; an additional 10 foot setback; and <br />CdEiEREAS, the Board of Zoning Appeals of the Village of hayfield have <br />approved the above described variances on the ground that, to require the <br />developer to meet the exact minimum area requirements for said sublots would <br />mean changing the layout of Northboro Drive and Aintree Parlc Drive to the <br />extent that the lots would not present the appearance that they have at the <br />present time and such variance is slight and would not set a pattern for <br />changing the minimum requirements; and <br />~tiFIiEREAS, Council determines, in accordance with the recommendation of <br />the Board of Zoning Appeals, that there are unnecessary hardships in the way <br />of carrying out the strict letter of the provisions of the Coning Ordinance <br />as to minimum area and that the approval of the above described Sublots <br />would be consistent with the public health, saf ety and welfare of the Village <br />of ivlayfield and its inhabitants and would secure substantial justice to all <br />persons concerned and would not cause injury or damage to any ,other property <br />in the Village of Nlayf field or the ownersthereof. <br />N04~ THEREFORE BE IT RESOLVED BY THE COUNCIL Oli TII"E VILLAGE OF MAYFIIa;LD <br />CUYAHOGA COUNTY, OHIO, THAT: ~ . <br />
