Mason A RESOLUTION Al'PP~OVING THE FINAL PLAN FOR AINTP,EE PARK SUBDIVISIONS NOS. 1, 2 AND 3 BUT NOI' FOR RECORD [~THEREAS, the preliminary plan of proposed Aintree Park Subdivisions Nos. 1, 2 and 3, has hitherto been approved by the Village Lngineer the Village Planning C Zoning Commission and Council, which included the approval of certain variances in the sizes of certain sublots; and G7HEREAS, the owner of the property contained therein has now acquired additional land and has submitted an Amended Final Plan brought about by the acquisition of 13 additional feet of land L-or the Raleigh Drive Right of [day as a result of which it became necessary to reduce the area of sublots 30 and 31 to 19,320 square feet each; and [~7fiEREAS, said Amended Final Plan, with stick variance, has been approved by the Village Engineer and the Village Planning and Zoning Commission; and [JIiEREAS, Council determines, in accordance with the recommendation of the Board of Zoning Appeals, that there are unnecessary hardships in the way_of carrying out the strict letter of the provisions of the zoning ordinances of the Village of T;ayfield as to said sublots 30 and 31 and that the approval of the above described sublots would be consistent with the public health, safety and welfare of the Village of Tiayfield and its inhabitants and would not cause injury or damage to any other property in •the Village of Dlayfield or the owner thereof. NO[J THEREFORE BE IT RESOLVED BY THE COUNCIL, OF THE VILLAGE OF I~IAYFTF,LD, CUYAHOGA COUNTY OHIO, THAT: Sec, 1. The Final Plan of Proposed Aintree Park Subdivisions Nos. 1, 2 and 3, approved on the 8th day of February , 1965, by the Village Engineer and on the 8th day of February 1965, by •the Planning and Zoning Commission, is hereby approved by Council, which further approves all variances in the sizes and areas in sublots in said subdivisions. This final plan, however, shall not be recorded or signed by the Clerk until compliance by the owner of. the property with Section 6 of Ordinance No. 468 relating to the improvement of streets has been obtained. The approval of this final plan does not constitute an acceptance of the dedication of any streets shown in said subdivision.
