RESOLUTION N0. 89- 1 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />REQUFSTING THS CUYAHOGA COUNTY AUDITOR <br />TO ADVANCE TA7E5 FROM THL PROCEEDS OF TAX LEVI&S <br />AND DECLflRING AN F.MffitGENCY <br />WHERRAS, Section 321.34 of the Ohio Revised Code provides that money in a <br />County Treasury to the account of a local authority and lawfully applicable to <br />the purpose of the current fiscal year may be withdrawn by a municipality upon <br />proper request; and <br />WHEREAS, the Council has found and determined that sound fiscal policy <br />requires that such withdrawal be requested from the Cuyahoga County Auditor; <br />now, therefore, <br />BE IT RFSOLVED BY THS COUNCII. OF MAYFffi,D VILLAGB, Offi0, THAT: <br />SECTION 1. The Cuyahoga County Auditor be and is hereby requested to <br />draw warrants and the Treasurer of Cuyahoga County be and is hereby requested <br />to pay the Village of Mayfield all monies presently being held in the Cuyahoga <br />County Treasury to the account of the Village of Mayfield, lawfully applicable <br />to the purpose of the present fiscal year. <br />SHCTION 2. The Clerk be and is hereby authorized and directed imme- <br />diately to forward a copy of this Resolution to the Cuyahoga County Auditor <br />and the Cuyahoga County Treasurer. <br />SECTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption o£ the Resolution have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements, including the <br />requirements o£ Section 121.22 of the Ohio Revised Code. <br />SHCTION 4. This Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the health, safety and welfare <br />of the residents of Mayfield Village in that the monies requested herein are <br />necessary to maintain essential governmental services.
