CARPffid, RSPEALING ALL RSSOLUTIONS INCONSISTSNT T?L+WITH AND DECLARING Ald EMERGSNCY BE IT RSSOLIISD BY THE COUNCIL OF MAYFIffi,D VILLAGE, OHIO, THAT: SECTION 1: Section 1 of Resolution No. 88-65 is hereby amended to read as follows: (Deleted material appears like tiri.s and new material appears like THIS.) SECTION 1: Thomas P. Gill is hereby specifically employed as special counsel in the matter of State of Ohio v. Fred N. Carmen, to take any and all actions deemed necessary on behalf of the Mayor in this action, whereas £or such services Thomas P. Gill shall be paid AT AN HOURLY RATE OF ONE HUNDRED DOLLARS ($100.00) PER HOUR, in the amount not to exceed Five Thousand Dollars ($5,000.00). SECTION 2: All prior Resolutions inconsistent with this resolution, in whole or in part, are repealed to the extent necessary to avoid conflict with this resolution. SLCTION 3: The Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberation of this Council and of its Committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SSCTION 4: This Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reason that it provides for the administration of the Law Department, a function mandated by Charter.
