O1/19/89 <br />- RESOLUTION N0. 89- q <br />INTRODUCED BY: Mayor Carmen and the Entire Council <br />A RESOLUTION <br />THORIZING THE FINANCE DIRECTOR TO <br />PAY THE SURCHARGFS ASSESSSD BY <br />HOUSE BILI. N0. 592 ADID <br />DECLARING AN EPffiiGBNCY <br />WHEREAS, Mayfield Village entered into an Agreement with Waste Management <br />of Ohio - Western Reserve for rubbish removal services within the Municipality <br />from August 1, 1988, through July 31, 1991; and <br />WHLREAS, subsequently, House Bill No. 592 was enacted to provide for <br />comprehensive solid waste management; and <br />WHLREAS, House Bill No. 592 states that additional surcharges will be <br />assessed on each ton or three (3) cubic yards of waste taken to the area <br />landfills; and <br />WHSREAS, the Mayor and Council are desirous to authorize the Finance <br />Director to pay such surcharges in compliance with House Bill No. 592; now, <br />therefore, <br />BE IT RBSOLVED BY THE COUNCIL OF MAYFffi,D VIIS,AGS, OHIO, THAT: <br />SECTION 1. The Finance Director is authorized to pay the surcharges in <br />compliance with House Bill No. 592, such amount to be reflected on the monthly <br />statement issued by Waste Management of Ohio - Western Reserve. <br />SECTION 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings o£ this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 af the Ohio Revised Code. <br />SSCTION 3. This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and welfare of <br />the residents of Mayfield Village for the reasons stated in the preamble.
