RESOLUTION No®669 <br />By Mr. Mason <br />,A, RESOLUTION OBJECTING TO THE ISSUANCE OF ,A C-2-1 <br />LI(~aiJOR_ PERMIT TO JAY DRUG STORES, INC. ON _ SOM <br />C:SiVTER ROAD. SOUTH -OF WILSON. MILLS ROAD IN THE <br />VILT,AGE OF _MAYFIELD, OHIO. <br />WHEREAS, the Cleric-Treasurer of the Village of Mayfield has received <br />a notice. dated February 14, 1966, from the Director of the Department of Liquor <br />Control of the State of Ohio of the filing of an application by Jay Drug Stores, <br />Inc. for a C-2-1 Liquor Permit for use on SOtiiI Center Road South of Wilson Mills <br />Road in the Village of Mayfield, Cuyahoga County, Ohio; and <br />WHEREAS, this Council finds that said premises are not suitable for the <br />operation of such a permit, because they are immediately adjacent to the premises <br />of the Mayfield Methodist Church and there is only 54.6 feet between the building <br />in which said permit would be used and the main church building, and Council <br />would deem it detrimental to the morals and welf are of the community to permit <br />the sale of any kind of liquor so near to the church. <br />NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF MAYFILI.,D, <br />CUYAHOGA COUNTY OHIO, . THAT: .. - - - .. -- <br />Sec, 1. The Council of the Village of Mayf field, Ohio, hereby objects <br />to the issuance of a C-2-1 Liquor Permit to Jay Drug Stores, Inc. at SOM Center <br />Road South of Wilson Mi11s Road in the Village of Mayf field, Ohio, on the basis <br />of the suitability of the location described in the notice received from the <br />Department of Liquor Control for the reasons hereinabove stated. <br />Sec. 2.~The Clerk-Treasurer is hereby directed to send to the Director <br />of the Department of Liquor Control two certified copies of this Resolution, <br />together with a written statement, to be signed by the Mayor,of Council*s <br />reasons for objecting to the issuance of said permit, a copy of which statement <br />has been filed with this Council and is hereby approved. <br />Sec. 3. This Resolution is hereby deemed to be an emergency measure, <br />necessary for the immediate preservation of the public morals, peace, health, <br />safety and welfare of the Village of Mayfield and its inhabitants, in that the <br />public welf are and morals will be endangered by the sale of liquor so hear to <br />a church, unless the objections of this Council are transmitted to the Director <br />of Liquor Control within 30 days after the date of the notice sent by him, and <br />this_ Resolution shall be in full force and effect from and after the date of <br />its adoption. <br />Adopted this 21st day of February, 1966, <br />attest: ~ - <br />•_ yor - President of Council <br />L~ ,~ <br />r/J' ~ - <br />SEAL~ C er -Treasurer <br />
