RESOLUTION N0. 89-16 <br />INTRODUCED BY: Mayor Carmen and the Entire Council <br />APi R$SOLUTION <br />ZING THS LAW DIRECTOB TO INITIATS <br />LSGAL ACTION AGAINST NSORSD <br />AND DECLARING AN EPffiZGBNCY <br />WHSREAS, the residents and businesses of Mayfield Village have repeatedly <br />experienced problems with the sanitary sewer system; and <br />WHffi2EAS, the Mayor and Council have met with officials of NEORSD on <br />numerous occasions in order to rectify such problems; and <br />WHEREAS, the Mayor and Council have been unsuccessful in stopping the <br />continuing threat to the environment through Administrative channels;and <br />WHSREAS, the Mayor and Council is desirous of authori2ing the Law <br />Director to initiate legal action against NEORSD to preserve the health, <br />safety and wel£are of the residents and transients of Mayfield Village. <br />BE TT RESOLVSD BY THS COUNCIL OF MAYFISLD VILLAGE, OHIO, THAT: <br />SECTION 1. The Law Director is hereby authorized to initiate legal <br />action against NEORSD to rectify the continuing problem of the sanitary sewer <br />system in order to preserve the health, safety and welfare of the residents <br />and transients of Mayfield Village. <br />SECTION 2. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with a11 statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the health, safety and welfare <br />of the residents of Mayfield Village, Ohio, for the reason that is stated in
