04/06/89 Failed 4/10/89 <br />RESOLUTION N0. 89-24 <br />INTRODUCED BY: Mayor Carmen and the Entire Council <br />A RESOLUTION <br />DECLARING NORTHEASTERN ROAD IMPROVEMENT COMPANY TO BE <br />THE LOWEST AND BEST BIDDER FOR THE CONSTRUCTION OF THE <br />SERVICE ROAD AND GRADING, AUTHORIZING THE MAYOR AND <br />PRESIDENT OF COUNCIL TO EXECUTE A CONTRACT WITH SAID BIDDER, <br />REJECTING OTHER BIDS RECEIVED AND DECLARING AND IIMERGENCY <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. In accordance with the bids received pursuant to advertise- <br />ment as required by law, Northeastern Road Improvement Company is hereby <br />declared to be the lowest and best bidder for the construction of the service <br />road and grading. <br />SECTION 2. The Mayor and President of Council are hereby authorized and <br />directed to execute a contract with said bidder in an amount not to exceed <br />Sixteen Thousand Eight Hundred Sixty Five Dollars ($16,865.00) provided that <br />the same is in accordance with the specifications upon which the bid was <br />received. <br />SECTION 3. All other bids received are hereby rejected. <br />SECTION 4. The Council finds and determines that all £ormal actions of <br />this Council relating to the adoption o£ this Resolution have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 5. This Resolution is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of <br />Mayfield Village, Ohio, for the reason that the contract authorized herein is <br />necessary to make required improvements on the municipal-owned property.
