RESOLUTION No. ;714 <br />By Mr. MASON <br />A RESOLUTION DETERMINING THAT THE IMPROVEMENT OF WORTON <br />PARK DRIVE, FROiI WILSON MILLS ROAD TO HEMINGWAY ROAD, <br />BY GRADING AND PAVING WITH ASPHALTIC CONCRETE MATERIALS, <br />SHOULD BE MADE AFTER A HEARING PURSUANT TO REVISED CODE <br />SECTION. 727.24. <br />WHEREAS, the lowest and best bid for labor and materials for the improve- <br />ment hereinafter described exceeds the estimated costs for labor and materials <br />as filed in the office of the Clerk-Treasurer of this Council prior to adoption <br />of Resolution No. 704, declaring the. necessity of said improvement, by 15% or <br />more, and pursuant to the requirements of Section 727.24 of the Ohio Revised <br />Code, a notice of a hearing on the question of whether the improvement should <br />be made was published once in a newspaper of general circulation in the Village <br />of Mayfield at least 48 hours prior to such hearing. <br />NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, <br />CUYAHOGA COUNTY OHIO, THATs - <br />Sec. 1. This Council, after hearing the owners of property to be assessed <br />for the improvement of Worton Park Drive, from Wilson Mills Road to Hemingway <br />Road, by. grading and paving with asphaltic concrete materials, as described in <br />Resolution No. 704, adopted Harch 20, 1967, and after reviewing the lowest and <br />best bid for labor and materials for said improvement, does hereby determine <br />that such improvement should be made and hereby authorizes and directs that <br />all necessary action be taken to cause such improvement to proceed in <br />accordance with the provisions of law. <br />Sec. 2. This Resolution is hereby declared to be an emergency measure, <br />necessary for the immediate preservation of the public peace, health, safety <br />and welf are of said Village, and for the further reason that the early <br />construction of said improvement is necessary to eliminate existing traffic <br />hazards to pedestrian and vehicular traffic as soon as possible, and this <br />Resolution shall be in full force and effect from and immediately after its <br />passage. <br />Adopted this 16th day of October, 19670 <br />L~ <br />Attests l <br />/~ ~ Mayor - President of Coun i1 <br />vl <br />(Seal) Clerk-Treasurer <br />
