<br />A RESOLUTION OBJECTIi~TG TO THE ISSUANCE OF A D-3 LIQUOP. PEt"ufIIT
<br />TO r4A1?TIN H, LAX, AT THE CQRNER OF TNTERSTATE 271 Ai~TD WILSON
<br />MILLS ROAD, IN 'THE VILLAGE OF 25AYFIELD, OHiO.
<br />WHEP~EAS,.the Cleric-Treasurer of the Village of iriayfield, Ohio, has
<br />received a notice dated IKay 21, 1963, from the Director of the Department of
<br />Liquor Control of the.State of Ohio, of the filing of Application No. 5066953-
<br />0015, by Ziartin H, Lax, for a D-3 Liquor Permit for use at the corner of Inter-
<br />state 271 and Wilson I~Iil1s Road, in the Village of Mayfield, Ohio; and
<br />WHEREAS, Council i.s n.ot satisf-ied as to the suitability of the location
<br />proposed, inasmuch as the applicant is not the owner or operator of a night club,
<br />hotel, restaurant, or.other place o~ business within the.contemplation of Sections
<br />4303.01(B)(12) through (14), 4303.],3 through 4303.16-, 4303.25, 4304,27, and
<br />4303.10 of the Revised Code of Ohiq, and the proposed premises constitute a vacant
<br />parcel of land with no construction started, nor application for a building permit
<br />made, and the application does not.state.wliich corner of Interstate 271 and tdilson
<br />Pii11s Road is contemplated for use by .the applicant, and further, inasmuch as all
<br />land on the southerly corners of this intersection are zoned for single residential
<br />.use only.
<br />NOW, .THEREFORE, BE IT RESOLVED BY THE COUNCIL OF .THE VILLAGE OF P•SAYFIELD,
<br />CUYAITOGA COUNTY, OHIO, THAT:
<br />Section 1. Council of the Village of Mayfield, Ohio, hereby objects
<br />to the issuance of a D-3 liquor permit to Tlartin I3. Lax, at the corner of Inter-
<br />state 271 and Wilson iKills Road, in .the Village of "L~iayfield,..Ohio, on the basis
<br />of the unsuitability of the location described in the notice received from the
<br />Department of Liquor Control.
<br />Section 2... The Clerlc-Treasurer is hereby directed to send to the
<br />Director of the Department of Liquor Control two certified copies of this Resolu-
<br />tion, together with a written statement, to be signed by the NZayor, of Council°s
<br />reasons for objecting to the issuance of said permit, a copy of which statement
<br />has been filed with this Council and is hereby approved.
<br />Section 3. This Pesolution is hereby deemed to be an emergency measure,
<br />necessary for the immediate preservation of the public morals, peace, health,
<br />safety and welfare of the Village of Mayfield and.its inhabitants, in that tYle
<br />public welfare and morals will be endangered unless the objections of this Council
<br />are transmitted to the Director of Liquor Control within 30 days after the date
<br />of receipt of the notice sent by him,~and this Resolution sriall be in full force
