<br />A RESOLUTION TO A~iI,c1D SECTION 7 OF RESOLUTION N0. 666,
<br />ENTITLED "A RESOLUTION DECLARING IT NECESSARY TO IMPROVE
<br />LANDER ROAD IN THE VILLAGE OF HAYFIELD, OHIO, BY GRADING,
<br />DRAINING, CUP,BING, PAVING (INCLUllING CURB COiQiJECTIONS,
<br />tdIIERE NECESSARY) AT3D IDISTALLITdG SIDEtdALKS, TOGETHER WITH. ALL
<br />NECESSARY APPURTENANCES, AIvTil DECLARING AI`T EMERGENCY."
<br />WHEP.EAS, Resolution No. 666, entitled: "A Resolution Declaring it
<br />Necessary to Improve Lander P.oad in the Village of P°Iayfield, Ohio, by Grading,
<br />Draining, Curbing, Paving (Including Curb Connections Where Necessary and In-
<br />stalling Sidewalks, Together with all Necessary Appurtenances, and Declaring an
<br />Emergency," adopted January 17, 1966; provided in Section 7 thereof, that the
<br />assessments to be levied shall be paid in 10 annual installments; and
<br />WHEP.EAS; subsequent to the adoption of said Resolution, a substantial
<br />majority of the otmers of a substantial majority of the frontage abutting the
<br />proposed improvement filed a written Petition wit'n this Council, requesting that
<br />assessments for said improvement be levied over a 20 year period rather than a
<br />10 year period, because of the fact that said property owners were in the process
<br />of paying other burdensome assessments: and
<br />tJHL'P.EAS, in compliance with said request of said property ow~.zers,
<br />Council, in Ordinance No. 946, being the Ordinance determining to proceed with
<br />the improvement of Lander Road by grading, draining, curbing, paving (including
<br />curb connections where necessary) and installing sidewalks, together with all
<br />necessary appurtenances, provided that the portion of costs of said improvement
<br />to be paid by the property owners shall be assessed in 20 annual installments.
<br />NOW, THEREFORE, BE IT RESOLVED BY COUTICIL OF THE VILLAGE OF i~1AYFIELD,
<br />CUYAIiOGA COUNTY, OHIO, THAT:
<br />Section 1. Section 7 of said Resolution No. 666 is hereby amended to
<br />read as follows:
<br />"Section 7. That the assessments to be levied shall be paid
<br />in 20 annual installments, with interest on.deferred payments at the
<br />same rate as shall be borne by the bonds to be issued in anticipation of
<br />the collection thereof;-provided, that the owner of any property assessed
<br />may, at his option, pay such assessment in cash, within 30 days after
<br />passage of the assessing Ordinance."
<br />Section 2. This Resolution is hereby declared to be an emergency
<br />measure, necessary for the immediate preservation of the public peace, health,
<br />safety and welfare of said Village, because of the necessity of providing funds
<br />
