RESOLUTION N0. 768 <br />BY: MR. FITZ=GERALD <br />A RESOLUTION OBJECTING TO THE ISSUANCE OF A <br />D-5 LIQUOR PER'KIT TO VILLAGE CORP. DBA VILLAGE <br />GREEN 847 SOM CENTER ROAD, HAYFIELD VILLAGE, OHIO. <br />WHEREAS, the Clerk-Treasurer of the Village of Mayfield has received <br />a notice dated January 6, 1970, but actually mailed and postmarked January 14, <br />1970, from the Director of the Department of Liquor Control of the State of <br />Ohio of the filing of an application by Village Corp. dba Village Green for a <br />D-5 Liquor Permit for use at 847 SOM Center Road in :the Village of Mayfield, <br />Cuyahoga County, Ohio, and <br />WHEREAS, this Council finds that said premises are not suitable for <br />the operation of such a permit because the building and the location thereof, as <br />described in the notice, are not suitable for such use. <br />NOW, THEREFORE, Be It Resolved by the Council of the Village of <br />Mayfield, County of Cuyahoga, Ohio, that: <br />Section 1. The Council of the Village of Mayfield, Ohio, hereby objects <br />to ,the issuance of a D-5 Liquor Permit to Village Corp. dba Village Green for use <br />at 847 SOM Center Road in the Village of Mayfield, Ohio, on the basis of the <br />suitability of the location described in the notice received from the Department <br />of Liquor Control. <br />Section 2. The Clerk-Treasurer is hereby directed to send to the <br />Director of the Department of Liquor Control two certified copies of this <br />Resolution, together with a written statement, to be signed by the Clerk- <br />Treasurer, of Council's reasons for objecting to the issuance of said permit, <br />a copy of which statement has been filed with this Council and is hereby approved. <br />Section 3. This Resolution is hereby deemed to be an emergency measure <br />necessary for the immediate preservation of the public morals, peace, health, safety <br />and welfare of the Village of Mayfield and its inhabitants, in that the public <br />welfare and morals will be endangered by the sale of liquor at the proposed <br />location, unless the objections of this Council are transmitted to the Director <br />of Liquor Control within thirty days after the date of the notice sent by him, <br />and this Resolution shall be in full force and effect from and after the date of <br />its adoption. <br />Adopted this 5th day of February, 1970. _ <br />~r~ <br />,r~=""~ <br />:,~ <br />ATTEST: „ ~ ~~J (MAYOR-PRESIDENT OF COUNCIL <br />/n <br />\\j <br />(SEAL/) I!
