o K <br />M. V. RESOLUTION N0. 89-39 <br />Page -2- <br />SECTION 3. The acceptance of such bid and authorization to execute such <br />contract is conditioned on the municipality receiving by July 20, 1989, <br />executed temporary right-of-entries and perpetual easements as approved by the <br />Law Director from the adjacent property owners to wit: Dennis and Laura <br />Cardarelli, Bruce and Helene Finke, Milan and Maria Buzdon, Robert and Shirley <br />Newkirk and No-rtnan-and-Gonst-anee-Koteeti⢠<br />SECTION 4. All other bids received are hereby rejected. <br />SECTION 5. The Council finds and determines that all form actions of <br />this Council relating to the adoption of this Resoluti/including een taken at <br />open meetings of this Council; and that deliberations ouncil and of <br />its committees, resulting in such formal action, took meetings open <br />to the public, in compliance with all statutory requirthe <br />requirements of Section 121.22 of the Ohio Revised Cod SECTION 6. This Resolution is hereby declarp'd to be an emergency measure <br />immediately necessary for the immediate preserv fion of the health, safety and <br />wel£are of the residents of Mayfield Village, io, for the reason that the <br />purchase authorized herein is necessary to m ntain effective drainage <br />throughout the municipality.
