07/14/89 <br />RESOLUTION N0. 89-44 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />URGING THE UNITED STATES CONGRESS TO <br />SPONSOR AN AMENDMENT TO THE CONSTITUTION <br />OF THE UNITED STATES OF AMERICA AS TO PROHIBIT <br />THE BURNING OR OTHER DEFACING OF THE AMERICAN FLAG <br />WHEREAS, the United States Supreme Court has recently ruled that burning <br />or otherwise defacing the American flag as a form of political protest is <br />protected under the First Amendment of the Constitution of the United States <br />as freedom of speech or expression; and <br />WHEREAS, the aforementioned ruling by the United States Supreme Court <br />renders unconstitutional any statute or ordinance prohibiting the burning or <br />defacing of the American flag if a violation of such is punishable as a <br />criminal offense; and <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio do not believe <br />that the majority of the American people agree that the freedom of speech or <br />expression, as protected by the First Amendment to the Constitution of the <br />United States was intended to protect conduct that so blatantly degrades the <br />leading symbol of the country; and <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio believe that an <br />amendment to the Constitution of the United States should be adopted to <br />prohibit the burning or defacing of the American flag; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, TfIAT: <br />SECTION 1. The Mayor and Council of Mayfield Village, Ohio urges the <br />United States Congress to sponsor an amendment to the Constitution of the <br />United States to prohibit the burning or other defacing o£ the American flag. <br />SECTION 2. The Clerk of Council is hereby authorized and directed to <br />forward copies of this Resolution to Senators Aoward Metzenbaum and John <br />Glenn, and to Representatives Edward F. Feighan, Mary Rose Oakar, Louis Stokes <br />and Dennis Eckhart, and in so doing to request written response from each to <br />this Resolution. The Clerk of Council is further authorized and directed to <br />forward duplicate copies of this Resolution to the Clerks of Council for the <br />other municipalities in the Hillcrest Area.
