RESOLUTION N0. 769 <br />BY: MR. Davis <br />A RESOLUTION OPPOSING THE ABOLITION OF AIAYOR'$ COURTS <br />WHEREAS, the news media have reported that legislation to abolish . <br />Mayor's Courts will be considered by the Ohio General Assembly in 1970, as a result <br />of recent court decisions denying appeals from decisions of l~iayor`s Courts, and <br />WHEREAS, there is a conflict in the lower and appellate court decisions <br />as to whether an appeal may be taken from a decision of a Mayor's Court, and such <br />question has not been finally determined by the Supreme Court, and <br />WHEREAS, the Mayor`s Courts are an integral part of the criminal justice <br />system, and <br />WHEREAS, A~fayor's Courts are better suited for the handling of purely local <br />criminal matters involving violations of municipal ordinances, and <br />TdEIEP,EAS,.the abolition of Mayor's Courts would cripple law enforcement in <br />Ohio's villages and small cities by requiring police officers to travel considerable <br />distances to file affidavits and attend court hearings for minor traffic violations <br />and other offenses, while leaving their communities without adequate police protection. <br />NOj^~, THEREFORE, Be It Resolved by the Council of the Village of Mayfield, <br />County of Cuyahoga, State of Ohio, that: <br />Section 1. The members of the General Assembly are urged to await the <br />final disposition of the question of appeals from Mayor's Courts to higher courts, <br />and to defer consideration of the proposed legislation to abolish Mayor's Courts, <br />until the final determination of the aforementioned issue has been made and other <br />acceptable alternatives to the abolition of Mayor's Courts can be fully explored in <br />the light of the status of the law as determined by the Supreme Court. <br />Section 2.
