Section 2: This municipality shall join with all <br />other affecte municipalities enacting similar legislation in <br />sponsoring engineering and technical studies to determine the <br />proper rate structure for the Cleveland Water System in order <br />to gain insurance that the problems of the future have been <br />well considered and to provide testimony in any legal action <br />which may be instituted under Section 1 of this Resolution. <br />Section 3: The Cuyahoga County Mayors and City <br />Managers Associat on is authorized to coordinate such legal <br />action and to employ such professional assistance as it may <br />deem necessary.to carry out the intention of Sections 1 and 2 <br />of this Resolution. <br />Section 4: The Clerk is authorized, empowered and <br />directed to~:ce~ rti~y a copy of this legislation to the Executive <br />Secretary of the Cuyahoga County Mayors and City Managers <br />Association. <br />Section 5: The sum of $315.00 is hereby appropriated <br />and shall a paic to the Cuyahoga County Mayors and City Managers <br />Association for the purpose of paying the expenses incidental <br />to the coordination of such activity and employment of~profes- <br />sional assistance, which funds shall be held in escrow, disbursed <br />as necessary, and accounted for at reasonable intervals or at <br />any time upon request, with the unused portion of funds to be <br />returned to this municipality at the conclusion of litigation. <br />Section 6: This resolution is declared to be an emer- <br />gency measure in t at this municipality and its residents have <br />been deprived of rights and property by the actions of the City <br />of Cleveland in raising water rates, thus necessitating immedi- <br />ate concerted action to prevent further deprivation, to recover <br />losses suffered to date, and to insure adequate water service <br />in the future.
