Section 2: This municipality shall join with all other affecte municipalities enacting similar legislation in sponsoring engineering and technical studies to determine the proper rate structure for the Cleveland Water System in order to gain insurance that the problems of the future have been well considered and to provide testimony in any legal action which may be instituted under Section 1 of this Resolution. Section 3: The Cuyahoga County Mayors and City Managers Associat on is authorized to coordinate such legal action and to employ such professional assistance as it may deem necessary.to carry out the intention of Sections 1 and 2 of this Resolution. Section 4: The Clerk is authorized, empowered and directed to~:ce~ rti~y a copy of this legislation to the Executive Secretary of the Cuyahoga County Mayors and City Managers Association. Section 5: The sum of $315.00 is hereby appropriated and shall a paic to the Cuyahoga County Mayors and City Managers Association for the purpose of paying the expenses incidental to the coordination of such activity and employment of~profes- sional assistance, which funds shall be held in escrow, disbursed as necessary, and accounted for at reasonable intervals or at any time upon request, with the unused portion of funds to be returned to this municipality at the conclusion of litigation. Section 6: This resolution is declared to be an emer- gency measure in t at this municipality and its residents have been deprived of rights and property by the actions of the City of Cleveland in raising water rates, thus necessitating immedi- ate concerted action to prevent further deprivation, to recover losses suffered to date, and to insure adequate water service in the future.
