BE IT RESOL'~IED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, <br />CUYAHOGA COUNTY, STATE Or OHIO, THAT: <br />Section 1: This municipality shall join with all other <br />affected municipa sties enacting similar legislation in all proper <br />legal action to enforce its rights under its contract with the <br />City of Cleveland for sewage treatment service, and authorize <br />its inclusion as a party plaintiff in such action. <br />Section 2: The Cuyahoga County mayors and City <br />Managers Association is authorized to coordinate such a lawsuit <br />and to employ such professional assistance as it_may deem neces- <br />sary to the speedy successful conclus-ion of such litigation. <br />Section 3: The Clerk is authorized, empowered and <br />directed to cert. y a copy of this legislation to the Executive <br />Secretary of the Cuyahoga County Mayors and City Managers <br />Association. <br />Section 4: The sum~~~:of $330.00 is hereby appropriated <br />and shall a pay to the Cuyahoga_County Mayors and City NIanage-rs <br />Association for the purpose of paying the expenses incidental <br />to the coordination of suciz activity and employment of profes- <br />sional assistance, which funds shall be held in escrow, dis- <br />bursed as necessary and accounted for at reasonable intervals <br />or at any time upon request, with the unused portion of funds <br />to be returned to this municipality at the conclusion of <br />litigation. <br />Section 5: This resolution is declared to be an <br />emergency measure in that this municipality and its residents <br />have been deprived of rights and property by the actions of the <br />City of Cleveland necessitating immediate concerted action to <br />prevent further deprivation and to recover losses to date.
