BORDONARO <br />~ A RESOLUTION OBJECTING TO THE ISSUANCE <br />OF A D-1-2-3-3A LIQUOR PERMIT TO CARL MILSTEIN <br />IN THE VILLAGE OF HAYFIELD, OHIO <br />WHEREAS, the Clerk-Treasurer of the Village of Mayfield, Ohio, <br />has received on the 17th day of May, 1971, a notice from the Director <br />of the Department of the Liquor Control of the State of Ohio of the <br />filing of an application by Carl Milstein for use of a D-1-2-3-3A <br />Liquor Permit at 7201 Wilson Mills Road in the Village of Mayfield, <br />Ohio, and ' <br />WHEREAS, this Council finds that said premises are not <br />suitable for the operation of such a permit, because there is no <br />building situated on said premises and for the further reason that said <br />premises are zoned for residential uses only and the zoning ordinance <br />does not permit the operation of any business or restaurant or the sale <br />of liquor on said premises. <br />NOW, THEREFORE, Be It Resolved by the Council of the Village <br />of Mayfield, County of Cuyahoga, Ohio, that: <br />Section 1. The :Council of the Village.of Mayfield objects to <br />the issuance o a D-1-2-3-3A Liquor Permit to Carl Milstein at the <br />address above stated for the reasons hereinabove given. <br />Section 2. The Clerk-Treasurer is hereby directed to send to <br />Director o t e Department of Liquor Control two certified copies of <br />this Resolution, together with a written statement, to be signed by the <br />Clerk-Treasurer, of Council's reasons for objecting to the issuance of <br />said permit, a. copy of which statement has been filed with this Council <br />and is hereby approved. <br />Section 3. This Resolution is hereby deemed to be an emer- <br />gency measure necessary for the immediate preservation o.f the public <br />morals, peace, health, safety and welfare of the Village of Mayfield and <br />its inhabitants, in that the public welfare and morals will be endangered <br />by the sale of liquor at the proposed location, unless the objections <br />of this Council are transmitted to the Director of Liquor Control <br />within thirty days after the date of the notice sent by him, and this <br />Resolution shall be in full force and effect from and after the date <br />of its adoption. <br />' Adopted this 17th day of May, 1971. <br />
