Amended 10/31/89 <br />RESOLUTION N0. 89-52 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />RATIFYING THE AUTHORIZED EXTRA EXPENDITURES <br />IN THE PREVIOUSLY AWARDED CONTRACT TO <br />BURGESS & NIPLE, LIMITED TO DEVELOP ALTERNATE <br />SOLUTIONS FOR AINTREE NORTH DRAINAGE IMPROVEMENTS <br />AND TO OBTAIN FIELD DATA FOR THE HAFFEY LITIGATION, <br />AUTHORIZING THE DIRECTOR OF FINANCE TO PAY SUCH <br />AUTHORIZED EXTRA EXPENDITURES AND DECLARING AN EMERGENCY <br />WHEREAS, the Council of Mayfield Village, Ohio has previously adopted <br />Resolution 87-62 authorizing the Mayor and President of Council to execute a <br />contract with Burgess & Niple, Limited to prepare a storm drainage study for <br />Mayfield Village; and <br />WHEREAS, the aforesaid Resolution further authorized and directed that <br />such contract be executed in an amount not to exceed Taenty-Nine Thousand <br />Dollars ($29,000.00) for the a£oresaid study; and <br />WHEREAS, following commencement of said study, the municipality author- <br />ized extra additional work in order to develop alternate solutions for Aintree <br />North drainage improvements and to obtain field data for the Haffey litiga- <br />tion; and <br />WHEREAS, the Council of Mayfield Village is desirous of ratifying the <br />aforementioned informal approval for extra work in the amount of Eleven <br />Thousand Four Hundred Eorty-Four pollars and Seventy-One Cents ($11,444.71); <br />now, there£ore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The contract previously executed with the Burgess & Niple, <br />Limited, pursuant to Resolution No. 87-62, is hereby increased for extra work <br />performed by Burgess & Niple, Limited in the amount of Eleven Thousand Four <br />Hundred and Forty-Four pollars and Seventy-One Cents ($11,444.71). <br />SECTION 2. The Director of Finance is hereby authorized and directed to <br />make payment to Burgess & Niple, Limited in the extra additional amount <br />authorized herein. <br />SECTION 3. The Council £inds and determines that all formal actions o£ <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings of this Council; and that deliberations o£ this Council and of <br />its committees, resulting in such formal action, took place in meetings open
