Resolution No. 80 ~ Page 2. <br />for an order to. compel the Auditor of Cuyahoga County to distribute ninety <br />percent (90%) of the Local Government Funds for such County, which he presently <br />has available for distribution - and to further distribute ninety perc®nt (90%) <br />of such additional Local Government Funds for such County as may become available <br />during the balance of the year 1971 - all pending an appeal to this Court in <br />the within case. <br />It appearing .to this Court that all of the subdivisions of Cuyahoga <br />County entitled to receive a portion of the Loc~.l Government Funds for the <br />year 1971 have subscribed their approval to the distribution provided for in <br />this Journal Entry by their written consents filed with this Court, except <br />those subdivisions listed in Exhibit B of the MAtion, and that such non-consenting <br />subdivisions will not in any way be damaged by the interim distribution requested. <br />It further appearing to this Court that many of the consenting sub - <br />divisions of Cuyahoga County, requesting the interim distribution, will be <br />adversely affected financially if such interim distribution is not made. <br />NOjd, THEREFORE, BE IT ORDERED, ADJUDGED AND DECREED THAT, pending <br />the appeal of the County of Cuyahoga to this Court in the within case, or any <br />subsequent appeal to the Supreme Court of Ohio, the Auditor of Cuyahoga Coun"ty <br />be, and he hereby is, directed to distribute to each of the herein after listed <br />subdivisions of Cuyahoga County, yxcept the non-consenting subdivisions listed <br />in Schedule B of this Journal Entry, from the 1971 Local Government Funds <br />presently in his possession, the percentage of the total fund set forth opposite <br />each subdivisions's name in Column 3 of Schedule A of this Journal Entry, which <br />percentage amount in each case is approximately ninety percent (90%) of the <br />lesser of the percentage amounts allowed to each subdivision by the Cuyahoga <br />County Budget Commission or the Board of Tax Appeals - and to further distribute <br />to such subdivisions described in Schedule A the percentage described therein, <br />in Column 3 thereof, of such Local Government Funds for the year 1971 as shall <br />subsequently come into the Auditor's hands by reason of the additional sums <br />received during the balance of the year 1971] and to furthe$ distribute to those <br />non-consenting subdivisions described in Schedule B of this Journal Entry the <br />percentage amount set forth opposite its name, should such subdivisions here- <br />after file consenting Journal Entries with this Honorable Court, similar to <br />those filed by the other subdivisions attached to the Movants' Motion; provided <br />however that the said Auditor may make distribution in such amounts at <br />approximately such times as distribution would have been made if these appeals <br />had not been filed and that he shall pay all delinquent installments cahich would <br />have been made prior to the date of this Journal Entry. <br />IT ZS FURTHER ORDERED, ADJUDGED AND DECREED that the amounts so paid <br />by the County Auditor under the authority of this Journal Entry shall be <br />credited on the amounts of local government funds ultimately found due to each <br />of said municipalities and governmental subdivisions. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED that in the event a <br />final determination by this Court or the Supreme Court .results in a deter- <br />mination that consenting subdivisions herein cai11 receive less than the <br />amounts of interim distribution ordered herein, that the Auditor of Cuyahoga <br />
