os/zi/s9 <br />RESOLUTION N0. 89-60 <br />INTRODUCED BY: Mayor Carmen and the Entire Council <br />A RESOLUTION <br />CONFIRMING TfiE APPOINTMENT OF THE <br />LANDSCAPING ARCHITECT BY THE MAYOR AND <br />SETTING THE TERMS AND CONDITIONS OF COMPENSATION <br />AND DECLARING AN EMERGENCY <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The appointment by the Mayor of Gilbert Kostelec as Landscap- <br />ing Architect o£ Mayfield Village, Ohio, is hereby approved and confirmed. <br />SECTION 2. The Landscaping Architect shall perform the duties as set <br />forth in Chapter 1301 of the Codified Ordinances and for same shall be <br />compensated on an hourly basis at Fifty Dollars ($50.00) per hour for said <br />services, based upon monthly bills and statements o£ services, which shall be <br />submitted by the Landscaping Architect and duly approved. <br />SECTION 3. The Council finds and determines that all £ormal actions of <br />this Council relating to the adoption of this Ordinance have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />-'. to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and wel£are of <br />the residents of Mayfield Village, Ohio, for the reason of the necessity of <br />immediately providing £or a Landscaping Architect and establishing adequate <br />compensation therefore. It shall, therefore, take effect immediately upon the <br />passage by the af£irmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time allowed by <br />law.
