• oRDZNANcE Nom 84-42 <br />' INTRODUCED BY: MAYOR CAELMEN AND COUNCIL AS A WHOLE. <br />AN ORDINP,NCE ENACTING SECTIdn1 501 0999 OP THE <br />CODIFIEn ORDINAIVCES OF MA'YFZELD VILLAGE, OI3IO, <br />REQUIRING CERTAIN INPIATES COA]FIPdED TO MUNICIPAL <br />JAIL, PRISON, WORRHOUSE OR COUNTX JATL TO <br />REIr7BURSE T1YE 14UNICIPALITY FOR ITS EXPENSES <br />INCURRED AS A RESULT OF SAID CONFINEMENT AND <br />DECLARING AN EMERGENCY. <br />a oo ? <br />WHEREASa the Ohio General Assembly has enaci:ed Amended Sub. <br />H.B. 363 wllich became effective September 26, 1984; and <br />WHEREAS, said House Bill authorizes this Council to require <br />any person convicted of an offense other than a minor misderneanor to <br />reimburse the municipality for expenses incurrec7 by reason of such <br />confinement incluciing, but not limited to, expenses reTating to the <br />provisimn of food, clothing, and shelter; and <br />WHEREAS, pursuant to the provisions of said Iiouse Bill the <br />reimbursement may be required if confinement is in a municipal jail, <br />raorkhouse, prison or county jail; and <br />WHEREAS, said House Bill further authorizes this Council to <br />c7ireck: tlze Director of Lav3 to inskitute an appropraate civil action to <br />recover the expenses incurred by the municipality as a result of said <br />confanement if tIze prisoner fails to pay; and <br />WHEREAS, the provisions of said House Bill, if implemented, <br />Eaill benefit the taxpayers of this municipality by requiring those <br />defendants able to pay to reimburse the Village for confinement costs <br />thereby alleviating the burden on taxpayers to pay the cost for those <br />who violate the law within the municipality; now, tcherefore, <br />BE IT ORDP,INED BY TFiE COiJNCIL 0F MAYFIELD VILLAGEe OHIO, TgiAT: <br />Section L, Section 501.999 ot the Codified Ordinances of <br />Mayfield Village, Ohio, is hereby enacted to read as follows: <br />501.999 Reimbursement for Confinement Costso <br />(a) Any person convicted of an offense other than a minor <br />misdameanor and who is thereafter confined in a municipal <br />jailP workhousep prison or county jail shall reimburse <br />this 3I1UY11.C1.pc'3.lity for its expenses incurred by reason of <br />said confinement including, but not limited toa the expenses <br />relating to the provision of food, clothing, and shelterm <br />The amount of reimburseanent shall be determi.ned by a court <br />of competent jurisdiction in an amount and in the manner as <br />prov3ded by law. <br />Li
