M.V. ORDINANCE N0. 85- 9 Page -2- CHAPTER 1367 Dwelling House Requirements * * * 1367.02 Garages for Dwelling Houses. All single-family and two-family houses shall be designea and constructed such that the door of an attached garage shall not face the street on which the house fronts. Section 4. Section 1359.01 of the Codified Orainances of Mayfield Village, Ohio, is hereby amendea to read as follows: (New material appears like THIS and deleted material appears like thts) Chapter 1359 Destruction ana Removal of Trees 1359.01 Removal Regulated; Permit Required. No person shall in any one calendar year, remove or destroy or cause to remove or destroy, by cutting, burning, -- bulldozing, or any other means, more than ten living trees having a truck diameter of nine inches or more at height of fourteen inches above the grouna level, or more than twenty five percent (25%) of the living trees having such trunk diameter, whichever is fewer, on any lot or parcel of land within the municipality without first receiving the permit for such purpose from the Municipal Engineer and the Building Commissioner. IF, HOWEVER, IN THE OPINION OF THE MUNICIPAL ENGINEER AND THE BUILDING COMMISSIONER, THERE ARE ADDITIONAL TREES THAT SHOULD B E REMOV ED OR DESTROYED BECAUSE THEIR LOCATION IS SUCH THAT THEY WILL SUFFER EXTENSIV E DAMAGE DURING CONSTRUCTION RESULTING IN THEIR ULTIMATE DEATH OR BECAUSE THEY WOULD INTERFER.E WITH THE LOCATION OF A DRIV EWAY THAT CANNOT PRACTICALLY BE LOCATED ELSEWHERE ON THE PROPERTY, THEN, WITH THE CONSENT OF THE MUNICIPAL ENGINEER AND THE BUILDING COMMIS5IONER, THE PERSON NEED NOT APPLY FOR THE PERMIT REQUIRED HEREIN BEFORE CAL7SING SUCH TREES TO BE REMOVED OR DESTROYED. Section 5. All prior orclinances inconsistent with this ordinance in whole or in part are repealed to the extent necessary to avoid conflict with this ordinance.
