ORDINANCE N0. 85- 20 <br />Page -5- <br />right-of-way shall conform with the requirements <br />of the Federal Highway Administration Policy and <br />Proceciure Memoranc3um 30-4 "Utility Relocation and <br />Adjustments" and the Ohio Department of Transportation <br />rules on Utility Accommodation. <br />F. The Municipality hereby agrees that the County shall <br />be and is hereby saved harmless from any and all damages <br />or claims thereof arising from or growing out of the <br />certification or obligations made or agreed to in <br />Sections 6A, 7A,B,C, and D hereinabove. <br />Section B. Mayfield Village, Ohio acknowledges that if <br />the County is formally reguested by Municipal Resolution to include <br />the construction of sanitary sewers, waterlines, area sewers (drainage <br />of area surrounding the improvement), sidewalks, alternate bicl items, <br />or other items in the improvement that are in addition to those now <br />existing, and not provided for elsewhere in this ordinance, the <br />Council will do so, provided that this construction meets with the <br />approval of the County and the Municipality involvecl in this <br />improvement; and that the Municipality agrees to pay the non-f ederal <br />costs of said additional construction and the costs of preliminary and <br />design engineering, but excluding construction supervision of said <br />aclditional work. <br />Section 9. Mayfield Village, Ohio further acknowledges <br />that for matter•s relating to this improvement, the agent for the <br />County and liaison officer on the matter contained herein shall be the <br />County Engineer of Cuyahoga County, Ohio, and/or such members of his <br />staff as he may designate. <br />Section 10. The Mayor is hereby authorized and directed <br />to enter into such agreements with Cuyahoga County as are necessary to <br />complete the planning and construction of the af oredescribed improve-. <br />ment. <br />Secta.on 11. The Mayor is hereby further authorized and <br />clireeted to make application to the Cuyahoga County Board of <br />Commissioners for approval to use County Motor Vehicle $5.00 License <br />Tax Funds for the aforesaid improvement. <br />Section 12. That the Council finds and determines that <br />all formal actions of this Council relating to the adoption of this <br />Orciinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />f ormal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code.
