M.V. ORDINANCE N0. 85-21 <br />Page -3- <br />or control of sexually oriented matter involving a child, a <br />misdemeanor of the first degree. <br />533.17 Possession of Nudity Oriented Material Involving a <br />Child. <br />(a) No person, shall possess any material that shows a <br />minor who is not the parent's child, or ward, in a state of <br />nudity, unless one of the following applies: <br />(1) The material is possessed or controlled <br />for a bonafide, artistic, medical, scientific, <br />educational, religious, governmental, judicial <br />or other proper purpose, by or to a physician, <br />psychologist, sociologist, scientist, teacher, <br />person pursuing bonafide studies or research, <br />librarian, clergyman,-prosecutor, judge or other <br />person having a proper interest in the material. <br />(2) The person knows that the parents, guardian, or <br />custodian has consented in writing to photographing <br />or use of the minor in a state of nudity, and to <br />the manner in which the material is used or <br />transferred. <br />(b) Whoever violates this section is guilty of possession <br />or control of nudity oriented material involving a minor, a <br />misdemeanor of the first degree. <br />Section 3. All prior ordinances inconsistent with this <br />ordinanc'e in whole or in part are repealed to the extent necessary to <br />avoia conflict with this ordinance. <br />Section 4. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />Section 5. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reasons set forth in the preamble hereto. It shall therefore take <br />effect immeaiately upon passage by the affirmative vote of not less <br />than four (4) members elected to Council and approval by the Mayor or
